Let's cut to the chase, is the real issue you're having here the console platform it's on, or what, because I don't get how what Sam is wearing is this big issue.
Sam Fisher, who no longer has strong ties or is interested in working for Third Echelon, and is working mostly on pursuing his own personal ends, has a more civilian and casual look?
It's makes so little sense I can't even wrap my head around it. Can you say that Bourne is in a similar situation as Sam, yes, I guess you can. But describe to me one case that makes sense where a top agent goes rogue and is mostly working on his own without all the same resources at his disposal where the chances aren't particularly high that our agent in question will maintain a more civilian appearance? More times than not, you would expect a more casual approach to things.
He's going to be walking around on the street in broad daylight or sitting down enjoying a cup of coffee, like he was at some cafe in Malta, wearing his Chaos Theory, Third Echelon gear? Come on.. that just doesn't make any sense.
Another thing that just blows me away is how at no point in any of your arguments, at least not that I've seen, are you considering the story specific circumstances of the main character that prompt, and basically explain his need for more civilian attire. It's almost as if Sam were wearing the exact same clothes that he wore in Chaos Theory and the game were 100% exactly as it is now, that simple change of clothes alone would be all that was required for people to consider this a real splinter cell.
Also, and maybe I'm mistaken, but Jason Bourne's backpack served the purpose of a portable EMP device like Sams? That backpack of his isn't just a simple backpack, it's a portable EMP device. Check for yourself.

More than that, I imagine if he's dressed down in the fashion that he is, that a backpack would most certainly be a necessary item...
